This privacy policy describes the personal data collected or generated (processed) when you receive e-mails from HumanWellness S.A. and the interactions derived therefrom. It also explains how personal data is collected, processed, shared and protected and what choices are available to you regarding your personal data and how to contact us.

Who is the personal data processing controller?

The company "HumanWellness S.A.", based in Via Ferruccio Pelli 9 - 6900 Lugano (CH) and CHE-201.466.193 personal data processing controller will interact and it will also depend on where you are in the world. In this privacy policy the company HumanWellness S.A. will be referred to as "HumanWellness","our" or "we".

WHAT personal data is collected and WHEN?

Some personal data may be requested in order to interact with our contacts. For example, when you contact our sales or marketing managers, our press office, or when you request to be contacted by phone.

This personal data includes or may include:

  • Contact details including contact name, e-mail, direct business or personal phone number (if specified by the contact as a means of business communication)
  • Company Data: Company name, VAT number, address of registered office, address of operative office, company telephone number (where necessary to establish commercial ties)

Upon interacting with our communications (e-mail), some data will be sent to our e-mail marketing platform and other data is automatically collected by your devices or browser. More information about these practices is included below in the "Cookies and Pixel Tags" section of this privacy policy. These data include:

  • Times and amount of e-mail openings, geographic area of interaction with our communications, opening platform (mobile or desktop), number of clicks on attached links, forwarding of individual communications.
  • Device ID, call status, network access, memory information.
  • IP addresses, referrer headers, data identifying the browser and version in use, web beacons and tags.

TOOLS for managing the Personal Data that is collected

At the time of opening our communications, our e-mail marketing platform will begin to collect the above-mentioned data, and at the time of interaction with the sites belonging to the companies that own these Privacy Policies (HumanWellness.ch) attached to our e-mails, we will give timely notice or request consent for certain practices. For example, we will ask for consent to collect browsing statistics. Consent may be obtained through our Sites or by using standard permissions available on your devices.

In many cases, your browser or mobile platform will provide additional tools that will allow to control when the device collects or shares certain categories of personal data. For example, the mobile device or browser may offer tools that will allow to manage the use of cookies or location sharing. We encourage familiarity and use of all the tools available on the various devices.

WHY and HOW personal data is used

We use personal data in the following ways:

To optimize our Sales and Marketing strategies:

We will use the above statistical data to improve our further communications, to help diagnose technical problems, to establish business relationships, to better manage our Sites or to create events and promotions for our contacts. For example, if an e-mail of ours is opened by a certain number of our contacts at a certain recurring time, this information will help us to optimize the times of further sending.

To ensure our rights, property or security

We may also use personal information in connection with your interactions with our communications (e-mail) to prevent or detect fraud, abuse, illegal use, and to comply with court orders, governmental requests, or applicable law.

For general research and analysis purposes

We use data about how our contacts interact with our communications (e-mail) to understand their behaviour and preferences as Partners or Customers (prospective or retained). For example, we can use information on how our contacts open and read our e-mails or how many times they click on the links attached within them. This way we understand the effectiveness of our message and we can recalibrate the written and graphic language of our possible new communications.

We may also use personal data in other ways and at the time of collection, we will give specific notice and request consent where necessary.

Legal reasons

We process personal data as required by law depending on the type of interaction with our communications.

  • We ask for consent after personal contact through signed paper consents.
  • We use consent to collect statistical data or to process personal data provided through our contact forms for reasons limited to the purposes described above.
  • For legal reasons, such as our legitimate business interests, to fulfill legal obligations, or to protect your vital interests.

SHARING of personal data

HumanWellness S.A. shares your personal data with:

  • The Commercial, Marketing and Press Office staff of "HumanWellness S.A." for the purposes and under the conditions described above.
  • Sales and Commercial Partners.
  • Service providers who process personal data on our behalf, e.g. Host, e-mail marketing tools for research and analysis or to provide certain services or feedback requested by you. When we use third-party service providers, we enter into agreements that require them to adopt appropriate technical and organizational measures to protect personal data.
  • Other third parties to the extent necessary to: (i) comply with a government request, court order, or to comply with applicable laws; (ii) prevent unlawful uses of databases containing your contact information or violations of the terms and conditions of use thereof or our internal policies; (iii) defend against claims by third parties; and (iv) facilitate fraud prevention or investigation (e.g. counterfeiting).
  • Other third parties, where consent has been granted.

We may also transfer the personal information we have in the event of a sale or transfer of all or part of our business or assets (including in the event of a reorganization, spin-off, dissolution or liquidation).

PROTECTION and MANAGEMENT of personal data

International transfers of personal data

Personal data that we collect (or process) in the context of our business partnerships and interactions with our e-mails and Sites will be stored on servers in Italy or elsewhere. Some of the data recipients with whom HumanWellness S.A. shares your personal data may be located in countries other than the country where your personal data was originally collected. The laws of those countries may not provide the same level of data protection as the country where your data was initially provided. However, when we transfer personal data to recipients in other countries, including Italy, we protect such personal data as described in this privacy policy and in accordance with applicable law.

Retention of personal data: we retain personal data for as long as necessary for the purposes set out in this privacy policy (unless otherwise required by law). In general, this means that we will retain personal data for as long as you maintain a communicational link with us. In the event that business or collaborative relationships are established, your data will be retained for a longer period of time to fulfill legal obligations (e.g. those required by tax and sales regulations and for warranty purposes).

RIGHTS relating to personal data

You have the right to request: (i) access to your personal data - Corporate; (ii) correction of your data if it is incomplete or inaccurate; or (iii) deletion or restriction of your data in certain circumstances provided for by applicable law. These rights are not absolute. If we have obtained your consent to process your personal data in any of the methods described above, you have the right to withdraw your consent at any time.

COOKIES e Pixel Tags

We collect information from e-mails sent through our e-mail marketing platform and information from your browser when you use our sites, without collecting any specific personal information about you. We use a variety of methods, such as cookies and pixel tags to collect this information, which may include among others: (i) IP address; (ii) domain, browser type and language; (v) operating system and system settings; (vi) country and time zone; (vii) previously visited websites; (viii) information about your interaction with our Sites, such as clicks made, purchases and preferences indicated; and (ix) access times and referring URL.

Third parties may also collect information from our e-mails or Sites via cookies, third-party plug-ins and widgets (e.g. Google Analytics). Third parties collect data directly from your web browser and the processing and treatment of this data is subject to their own privacy policies.

We use cookies and pixel tags to track interactions with each of our individual communications (e-mail) and use of our Sites to understand their preferences (such as language choices). This allows us to improve their online experience, identify usage trends and obtain statistics so that we can always improve our Sales, Marketing and Sites strategies.

For a complete and up-to-date summary of all third parties accessing the web browser, it is advisable to install a specially created web browser plug-in. You can also choose to have your computer send you a warning every time a cookie is sent, or you can choose to disable all cookies. You can do this in the browser settings on each browser and device that is used. Each browser is somewhat different. Thus, you will have to consult your browser help menu for the correct way to modify cookies. If you disable cookies, you may not have access to many features that make our Sites more efficient and some of our services will not function properly.

CHANGES to our privacy policy

Applicable law and our practices change over time. If we need to change the way we process personal data, we will provide notice, or where required by law, consent will be sought before implementing such changes. We strongly recommend that you read our Policy and keep yourself informed of our policies. The privacy policy was last modified in May 2018.
